5) ORDER PLACEMENT

By placing an order you are offering to purchase a product from the MEANINGFUL SHOE, subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Our Website permits you to check any errors before sending your order to us. If your order is accepted we will inform you by email. This acknowledgement e-mail confirming receipt of your order will constitute acceptance of your order and constitute the formation of a contract between the MEANINGFUL SHOE and you.

When placing an order you undertake that all details you provide to us are true and accurate, that you are over 18 years and are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

 

6) PRICING

The MEANINGFUL SHOE is committed to offering convenience, service, and product availability on-line at the best possible prices. Whilst we endeavor to keep prices online similar to those of product in Stores, the merchandise offered on-line at atheistberlin.com will often have different prices to merchandise available in any Stores stocking our brand. Typically, the retail price in Stores will reflect the true cost of purchasing our product online, i.e. Cost of Product, plus Taxes, plus Postage. Also, all prices advertised are subject to changes.

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

Currently, the prices you see on the Website exclude the cost of shipping and import duties. Depending on your delivery address there may be different taxation rules. If you are shipping items from a boutique outside of your territory, you may need to pay import duties upon receipt of your item.

We cannot confirm the prices indicated on the Website until your order is submitted to us. In any case, we do not charge your credit or debit card until your order has been actually confirmed by us, according to the following point

 

7) PAYMENTS

Upon receiving your order we carry out a standard pre-authorisation check on your payment card. Goods will not be dispatched until this pre-authorisation check has been completed.

Once we have verified your order and payment details and have approved your order for shipment, we will email you again to inform you of this. In the unlikely event that we encounter a problem when processing your order, you will receive an email from us detailing the problem and possibly requesting further information.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, if shipping restrictions apply to a particular item, if the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or if you do not meet the eligibility criteria.

The MEANINGFUL SHOE will archive a copy of your contract with the seller in its files, and you will able to retrieve a copy by communicating your data and those of the order.

In order to use the Services made available by the Website you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. We retains the right to refuse any request made by you.

 

8) DELIVERY

Dispatch times may vary according to availability and there are no guarantees as to delivery times. But we will always strive to deliver your order within 5 to 7 days of purchase, unless you are pre-ordering an item - in which case it may take up to 8 weeks to deliver your goods.

 

9) RETURNS & REFUNDS

We hope that all of our customers are happy with their purchases. If you are not happy with your purchase, or if the product we deliver is not what you ordered or is defective or damaged, please let us know at hello@atheistberlin.com as soon as possible and we will provide a refund or replacement in accordance with our Returns Policy.

 

International Returns Policy

We are happy to refund any purchases within 14 working days from receipt. To return an item you must our customer services at hello@atheistberlin.com to obtain a Returns Number which must be included with your return. All returns must be sent via registered mail, in their original condition, to the address below.

Please be sure to clearly mark your return shipment as returned goods on any customs or postal forms. We will refund any sums that you have paid to us with the exception of postage and packing. Only products that are in their original condition will be refunded, others will be returned to the customers at their own cost.

 

Free Postage on Returned Items

We would like to be able to offer free postage on the return of any items from locations within the EU, however we are not yet in a position to do so, partly because we are a fledgling operation and very much hopeful that we'll have enough money to still be operational 3 months from now. But also due to anticipated problems with fraud and sabotage. We will endeavor to overcome these issues and to implement a free returns policy as some future date.

 

Incorrect Order

Every so often mistakes will happen, but we will so our best to fix them and correct any issues you may have. If you have noticed that we have made a mistake with your order, please email us at hello@atheistberlin.com, and we will look into it. Please include your order reference at all times when e-mailing our customer services.

 

10) COLOURS

We have done our best to display as accurately as possible the colors of the products shown on the oki-ni.com web site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

 

11) CORRECTION OF ERRORS AND INACCURACIES

The information of the Web Site may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change and update information at any time without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We apologise for any inconvenience this may cause you. 12) TYPOGRAPHICAL ERRORS

In the event an atheistberlin.com product is listed at an incorrect price due to typographical error or systems error, the MEANINGFUL SHOE shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. The MEANINGFUL SHOE shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, the MEANINGFUL SHOE shall issue a payment to your credit card account in the amount of the incorrect price.

 

13) TERM: TERMINATION

These terms and conditions are applicable to you upon your accessing the site/ or completing the registration or shopping process. These terms and conditions, or any of them, may be terminated by the MEANINGFUL SHOE without notice at any time for any reason. ATHEIST BERLIN is chiefly available online and products primarily available through ATHEISTBERLIN.COM. We do have limited availability in select boutiques worldwide, and we will, on occasion, open temporary stores worldwide.

The statutory right of any person other than you or us to enforce any of these provisions is excluded.

 

23) SEVERANCE

If any term shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law that term shall to that extent be deemed not to form part of these terms and the enforceability of the remainder of the terms shall not be affected.

 

24) FORCE MAJEURE

If THE MEANINGFUL SHOE COMPANY LIMITED is prevented or delayed (directly or indirectly) from making delivery of the Products or any portion of the Products on the agreed date of delivery or from otherwise performing this or any part of this agreement by reason of act(s) of God, war, embargo, riot(s), strike(s), lock-out(s), trade dispute(s), fire(s), break-down, inclement weather, interruption of transport, Government action, delay in delivery to THE MEANINGFUL SHOE COMPANY LIMITED of any goods or materials or by any cause whatsoever (whether or not of like nature to those specified above) in each case outside such farfetch.com Limited's control («force majeure»), neither party hereto shall be under any liability whatsoever to the other party by reason of such event.

We expect our suppliers to consistently provide an environment which protects their employees' health and safety and basic human rights.
